  • Changes of legislation system of state procurements in Ukraine.

On 11.01.05 essential amendments to the legislation system of state procurements in Ukraine joined into force.

Law of Ukraine "On Making Changes in Some Legislative Acts of Ukraine".

Some key clauses from these amendments:

1. Amount and causes of punitive measures regarding to State Customers in case of infraction of the legislation in the sphere of State Procurements are defined in the Codex of Ukraine on Administrative Actus Reus.

2. Threshold sums of applying of the Law of Ukraine "On Procurement of Goods, Work and Services for Public Funds" have changed, namely, on purchasing of goods and services the minimum has increased from 2,000 EURO to 5,000, on the contrary, on purchasing of work the minimum has decreased from 100,000 EURO to 20,000 EURO.

3. Open information about every Tender will be placed in Internet Network, that is:

• Announcement about purchasing;

• Report about the results of conducting of the procedure of purchasing and all additions to it;

• Announcement about the Tender results;

• Information about the results of consideration of complaints.

4. Selection of informational system in Internet network will made on competitive basis by the State Customer.

5. Tender documents will be given (sent) to Tender participant during the period of three days since the moment of the payment for its cost. The document for paying for Tender documentation will be given (sent) to Tender participant during the period of three days since the moment of receiving of correspondent inquiry.

6. Obligatory guarantee insurance of Tender Proposal is established in the amount of: on purchasing of goods or services - 5%, on purchasing - 1%.

7. All expenses connected with signing of the Contract, may be put on the winner of purchasing procedure, subject to conditions of Tender documents.

8. Customer may conduct purchasing on the procedure of inquiry of price proposals (quotations) of goods and services in case if the total sum of purchase is not more than 10,000 EURO. Inquiry from the side of Customer shall be sent by minimum of 5 participants. For comparison: before the threshold sum was 20,000 EURO and inquiry was sent to minimum of 3 participants.
